V8R 1H8 Dear Sirs: Re: 198 Cliffside Road, Saturna Island, B.C. We are the Saturna Island Ratepayers and Residents Association (SIRRA), a B.C. Society incorporated to represent the collective interests of residents of Saturna with government bodies. As such, our members are very concerned about the project carried out by a person called David Hannay and an entity called 'Jasco' at the above address over the past approximately 2 years which appears to have involved a number of infractions of Saturna Island Local Trust Committee Land Use Bylaw No. 119 and possibly other regulations. It has created considerable Nuisance in the form of noise, pollution of air and water, physical effects of vibrations from drilling, and interference with the foreshore. It appears from complaints that have been received from local residents on Cliffside and elsewhere on Saturna that these bylaws have not been enforced. Specifically we refer to sections 2.15.1, .4, .7; and 2.16.1, .3, .4, .6; and 4.1.1 and 4.1.2 of Bylaw 119. It appears this project was funded by, but did not come under the regulatory jurisdiction of Transport Canada and possibly other Federal regulatory agencies. It also appears that the Province of British Columbia may have referred the matter to the Islands Trust for regulation. We are very concerned that the interests of residents and property owners of Saturna have not been protected by the governments elected and appointed to do so. This could happen apparently to any of us! We write to ask on behalf of our members and other residents of Saturna for the disclosure, and the enforcement processes which have apparently been ignored, or inadequate to date, specifically: 1. What knowledge did Islands Trust have of this project, and when? 2. What notice or advice did Islands Trust receive about its jurisdiction in this matter, and when? 3. What complaints did Islands Trust receive about this project, and when? 4. What investigations and enforcement action were taken, and when? 5. Will the Islands Trust now be investigating and enforcing appropriately the Bylaw? 6. When will the Islands Trust inform the public of Saturna about the history, current status, and proposed future regulation of this project? We ask that you respond in writing to the attention of the writer within 2 weeks of the date of this letter.
